Terms of Service

  1. Definitions
    1.1. “Customer” refers to the person or entity who orders services from Blazestone Hosting.
    1.2. “Customer Service” refers to the support provided by Blazestone Hosting to assist with customer inquiries.
    1.3. “eTicket” refers to a secure message sent by the Customer to Blazestone Hosting for support or questions.
    1.4. “Registry” refers to the organization handling domain services, including customer data management and DNS operations.
    1.5. “Service(s)” refers to any products or services provided by Blazestone Hosting, including web hosting, domain registration, SSL certificates, etc.
    1.9. “We,” “our,” or “us” refers to Blazestone Hosting (ABN 18 672 951 503).
    1.10. “You” or “your” refers to the Customer.
  2. Acceptance
    2.1. By placing an order, the Customer agrees to our Terms of Service, Acceptable Use Policy, Privacy Policy, and other relevant agreements.
    2.2. The Customer is responsible for ensuring that their Service(s) comply with these terms.
  3. Communication
    3.1. The Customer agrees to receive service-related and marketing communications from Blazestone Hosting via email or SMS.
    3.2. The Customer can opt-in for notifications about Service status.
    3.3. Customers may receive SMS notifications about service suspensions if a mobile number is provided.
    3.4. If the Customer does not wish to receive mandatory emails/SMS, they must cancel their Services and close their account.
  4. Availability of Services
    4.1. Blazestone Hosting strives to ensure continuous availability but is not liable for service interruptions not covered by an agreement.
    4.2. Scheduled maintenance will be notified at least two days in advance if it causes downtime longer than 30 minutes.
    4.3. Unscheduled maintenance will be posted with updates if downtime exceeds 30 minutes.
  5. Domain Names
    5.1. Blazestone Hosting processes domain registrations, transfers, or renewals through Synergy Wholesale Accreditations Pty Ltd.
    5.2. Customers must agree to the Registrant Agreement before purchasing domain names.
    5.3. Domain names are non-refundable once processed.
    5.4. Blazestone Hosting does not guarantee domain registration or transfer approval.
    5.5. Customers must follow the relevant terms and agreements for domain names.
    5.6. Blazestone Hosting is not liable if a domain name registration is refused by the Registry.
    5.7. Domain renewals will not occur if the Customer hasn’t confirmed or paid for the renewal.
    5.8. Domain services may be declined if the Customer is in breach of terms or has unpaid invoices.
    5.9. Customers must keep their contact details for domains up to date.
    5.10. If a domain is not transferred, Blazestone Hosting may contact the Customer after account closure about renewals or expirations.
    5.11. The Customer authorizes Blazestone Hosting to act as the Designated Agent for domain changes.
    5.12. Enabling ‘ID protection’ does not change registrant data.
    5.13. Blazestone Hosting resets transfer passwords after a domain transfer.
    5.14. .au domains may require verification via a secure form, and a $1.00 AUD fee applies per verification check.
    5.15. Refunds for domain names will not cover verification failures.
    5.16. The Customer agrees to provide valid personal information for .au domain verification.
    5.17. Pre-ordering a domain name does not guarantee successful allocation.
    5.18. Refunds will be issued for failed domain pre-orders within 30 days.
  6. Customer Responsibilities
    6.1. The Customer warrants that their provided information is true and up to date.
    6.2. The Customer is responsible for securing passwords and sensitive data.
    6.3. The Customer is not relying on any statements not explicitly mentioned in the agreement.
    6.4. The Customer is responsible for unauthorized access to their account and should report it to the authorities.
  7. Blazestone Hosting’s Responsibilities
    7.1. Blazestone Hosting is not liable for damage caused by the Customer’s Service(s) unless due to gross negligence or misconduct.
    7.2. Blazestone Hosting is not liable for lost profits, indirect damages, or any other form of economic loss.
    7.3. The maximum liability is limited to the amount paid by the Customer for the Service in the six months preceding the event.
    7.4. Blazestone Hosting does not guarantee uninterrupted service or protection against unauthorized access.
    7.5. No express or implied warranties are provided regarding goods or services.
    7.6. Blazestone Hosting is not liable for business or financial losses.
    7.7. Blazestone Hosting does not provide warranties for third-party services accessed by the Customer.
  8. Accounts and Billing
    8.1. Service(s) are provided on a month-to-month basis unless otherwise agreed.
    8.2. Services are renewed automatically each month unless canceled.
    8.3. Fees are billed in advance, with invoices sent 10 days before the due date. Payments are typically processed 3 days before the due date.
    8.4. Fees for upgrades are due within 7 days and may be prorated depending on the billing cycle.
    8.5. Downgrades may result in account credits, and additional fees may apply for manual processing.
    8.6. One-off services (e.g., SSL certificates) must be paid within 7 days.
    8.7. Prices include taxes unless stated otherwise.
    8.8. Unpaid invoices must be cleared before new Services are provided.
    8.9. Unpaid invoices may lead to collection actions and additional fees.
    8.10. Accounts with unpaid invoices over 7 days will be suspended, and payment is required for reactivation.
    8.11. Services with unpaid invoices over 14 days will be terminated.
  9. Payments by Credit Card
    9.1. Credit card details may be stored for future payments.
    9.2. Payments may be automatically processed from the stored card 3 days before the due date.
  10. Refunds
    10.1. Services such as domain names, SSL certificates, Microsoft 365, Google Workspace, and software licenses are non-refundable.
    10.2. Full refunds for web hosting services are available if requested within 45 days.
    10.3. Refunds after 45 days will be prorated to account credit.
    10.4. No refunds if the Customer breaches any terms.
    10.5. Refunds are subject to Blazestone Hosting’s discretion and Australian consumer law.
  11. Cancellation
    11.1. To cancel services, the Customer must submit a request via email.
    11.2. Refunds for prepaid services will be issued according to the Refunds section.
    11.3. The Customer agrees to pay outstanding invoices upon cancellation.
    11.4. If a service renewal is paid, a refund will be issued according to the Refunds section.
  12. Suspension and Termination
    12.1. Blazestone Hosting may suspend or terminate services for breaches of terms or unpaid invoices.
    12.2. Blazestone Hosting may notify the Customer of termination with 14 days’ notice.
    12.3. The Customer must pay all outstanding invoices upon account closure.
    12.4. Data may not be provided after suspension or termination, but backups can be requested for a fee.
  13. Data Management
    13.1. The Customer is responsible for maintaining offsite backups of their data.
    13.2. Blazestone Hosting provides backup services for web hosting but not for VPS or other services unless specified.
    13.3. Blazestone Hosting will restore data from backups if available, but the Customer should maintain their own copies.
    13.4. Backups requested by the Customer for non-fault reasons will incur a $49.95 fee.
    13.5. Backups are not guaranteed after service suspension or cancellation.
    13.6. Blazestone Hosting is not responsible for issues caused by third-party services or failed upgrades.
  14. Use of Identity
    14.1. The Customer agrees to follow Blazestone Hosting’s marketing guidelines if using their logo or information.
    14.2. Blazestone Hosting will not use the Customer’s name or logos without consent.
  15. Governing Law
    15.1. The Customer agrees to comply with all local laws related to the Services provided.
    15.2. These terms are governed by the laws of Sydney, Australia, and disputes will be handled in its courts.
  16. Changes
    16.1. Blazestone Hosting may update these Terms of Service at any time.
